Removal of Disqualification

In certain circumstances if you are disqualified it is possible for you to apply for the early return of your driving licence. However, you have to have been disqualified for more than two years. You can then apply to the court to have the disqualification reduced after:

  • Two years if you are disqualified for less than four years
  • Half of the period of disqualification if it is more than four years but less than ten years
  • Five years if you are disqualified for ten years or more

The court will consider your character, conduct subsequent to the conviction and the nature of the original offence. Applications are likely to be opposed by the prosecution and therefore we strongly recommend that you seek legal advice.

It is important that your case is presented properly because if the court refuses your application you cannot re-apply until three months after the date of the refusal.
