Driving Whilst Disqualified

It is a serious offence to be found driving on a road when disqualified and often attracts a prison sentence.

In order to be found guilty of such an offence the prosecution must prove that not only was the person driving but also that they were disqualified. If you are accused of such an offence and you dispute that you were either driving or disqualified at the time then you should seek immediate legal representation. At Motoring Law Defence we have a proven track record and are experts at finding weaknesses in the prosecution case.

The Penalty

The maximum penalty for being found guilty of this offence is 6 months in prison and £5,000. Also the court can disqualify the accused for any period and/or until a driving test is passed. Even if you are found guilty or plead guilty to such an offence, we can still help you by putting to the court your mitigating circumstances with the aim of achieving a better sentence for you.

Legal Aid

In relation to cases of driving whilst disqualified Legal Aid may be available to cover the cost of your representation and this is something we can discuss further with you.
